　　近期，上海市知识产权局根据外省知识产权维权援助中心移送的投诉材料，通过线上违法线索，查实上海某高温轴承制造公司假冒专利行为，依法责令涉案当事人立即停止违法行为，并处没收违法所得及罚款人民币共计184,460元。这也是迄今为止，上海在假冒专利案件查处中做出的Z大力度的行政处罚。

　　根据外省知识产权维权援助中心移送材料，位于上海的某高温轴承制造公司涉嫌假冒专利。经专利行政执法人员调查确认，涉案当事人在“中华机械网”销售的“高温轴承-窑车轴承-高温窑车轮用轴承”使用专利号及相关专利证书作为宣传展示，但所涉专利已因未缴年费而失效。执法人员立即责令涉案当事人予以整改，删除了其在“中华机械网”宣传展示的失效专利信息。

　　同时，为进一步查明案件事实，摸清涉案当事人线下专利违法情况，上海市知识产权局组织专利执法人员对涉案当事人开展现场执法检查，发现涉案当事人三种产品包装箱上均标注了六个专利号，且相关专利均已失效。通过多次调查，执法人员在掌握涉案专利来源、涉案产品包装箱使用及销售违法所得等情况的基础上，根据《专利法》、《专利法实施细则》规定，认定涉案当事人行为已构成假冒专利行为，并依法责令涉案当事人立即停止标注行为，消除尚未售出的产品包装箱上的专利标识，对专利标识难以消除的产品包装箱予以销毁，并处没收违法所得及罚款人民币184,460元。

　　该案从线上小线索入手，结合线下执法检查，及时发现并制止了更大范围、更加严重的假冒专利行为，通过依法严格保护，有效打击了专利侵权违法行为，切实保障了权利人的合法权益。
